D�viant de la ligne d'armistice de 1967 sur 80% de son trac�, le mur place du � c�t� isra�lien � pr�s de 10% de la Cisjordanie, encerclant m�me totalement certains villages. Selon les Nations Unies, 680 000 Palestiniens subiront directement l'impact de ce mur, �tant coup� de leurs terres agricoles, de leurs emplois, de leurs �coles, de leurs cliniques, etc. Quand il aura �t� compl�t�, dans environ un an, il aura co�t� plus de 3 milliards de dollars. Concr�tisation monstrueuse des politiques d'apartheid de l'occupation isra�lienne, ce mur est totalement ill�gal. Rappelons certains faits � cet �gard. *Le 8 d�cembre 2003*, l'Assembl�e g�n�rale des Nations Unies demande � la Cour internationale de Justice (CIJ) de La Haye de rendre un avis consultatif sur le mur. 90 pays votent _pour_ demander cet avis, 8 pays votent _contre_, et 74 pays _s'abstiennent_ -dont le Canada. Dans les semaines qui suivent, quelques pays �crivent � la Cour internationale de Justice pour contester sa comp�tence � se prononcer sur cette question; quelques autres - dont le Canada, le 29 janvier 2004 - demandent � respectueusement que la Cour exerce son pouvoir discr�tionnaire et refuse de r�pondre � la requ�te d'avis consultatif � ce moment-ci � ! *Le 9 juillet 2004*, 15 juges de la Cour internationale de Justice rendent leur d�cision : � Ils confirment la comp�tence de la CIJ en la mati�re (� l'unanimit�); � Ils acceptent de se prononcer (14 juges sur 15; seul dissident : le juge des �tats-Unis); � Ils r�pondent ceci : o � L'�dification du mur qu'Isra�l, puissance occupante, est en train de construire dans le territoire palestinien occup�, y compris � l'int�rieur et sur le pourtour de J�rusalem-Est, et le r�gime qui lui est associ�, sont contraires au droit international � (14 juges sur 15; seul dissident : le juge des �tats-Unis); o � Isra�l est dans l'obligation (...) de cesser imm�diatement les travaux d'�dification du mur, (...) de d�manteler imm�diatement l'ouvrage � (14 juges sur 15; seul dissident : le juge des �tats-Unis); o � Isra�l est dans l'obligation de r�parer tous les dommages caus�s par le mur � (14 juges sur 15; seul dissident : le juge des �tats-Unis); o � Tous les �tats sont dans l'obligation de ne pas reconna�tre la situation illicite d�coulant de la construction du mur (...); tous les �tats parties � la quatri�me convention de Gen�ve (...) ont en outre l'obligation (...) de faire respecter par Isra�l le droit international humanitaire incorpor� dans cette convention � (13 juges sur 15; seuls dissidents : les juges des �tats-Unis et des Pays-Bas); o � L'Organisation des Nations Unies et sp�cialement l'Assembl�e g�n�rale et le Conseil de s�curit�, doivent (...) examiner quelles nouvelles mesures doivent �tre prises afin de mettre un terme � la situation illicite d�coulant de la construction du mur (...) � (14 juges sur 15; seul dissident : le juge des �tats-Unis). *Le 20 juillet 2004*, l'Assembl�e g�n�rale des Nations Unies demande qu'Isra�l se conforme au jugement de la Cour internationale de justice : 150 pays votent _pour_ cette r�solution, 6 pays votent _contre_ et 10 pays _s'abstiennent_... dont le Canada ! La construction du mur est donc ill�gale. Tout comme le sont d'ailleurs l'occupation isra�lienne de la Cisjordanie et de la Bande de Gaza, la construction de colonies juives de peuplement dans ces territoires occup�s, l'annexion de J�rusalem-Est, la n�gation du droit au retour des r�fugi�s palestiniens, l'appropriation de l'eau souterraine des territoires occup�s, les milliers de d�tentions arbitraires et la torture inflig�e aux prisonniers palestiniens, les ch�timents collectifs tels la destruction des maisons ou des vergers des familles des pr�sum�s � terroristes � et les bouclages complets de villes et villages, les ex�cutions extra-judiciaires de pr�sum�s � terroristes � (parfois � coups de missiles et de bombes d'une tonne), etc. _Et que fait le Canada ?_ Face � tout cela, la politique canadienne est fondamentalement hypocrite et favorable � l'�tat d'Isra�l. Car m�me si le Canada affirme �tre contre l'occupation, la colonisation et le mur, il manque totalement � ses obligations en ne prenant aucun moyen pour qu'Isra�l respecte le droit international. Au contraire, il entretient avec Isra�l des relations commerciales privil�gi�es (trait� de libre-�change) et tente m�me d'emp�cher que le peuple palestinien puisse au moins faire reconna�tre au grand jour les violations isra�liennes du droit international. En insistant constamment sur la seule � solution n�goci�e �, le Canada occulte deux faits fondamentaux. D'une part, qu'il ne s'agit pas d'un � conflit � entre � parties �, mais qu'Isra�l est une puissance d'occupation ill�gale en Palestine. D'autre part, qu'Isra�l ne manifeste aucune intention r�elle de n�gocier, mais plut�t celle de gagner du temps et d'utiliser ce temps (et les 5 milliards d'aide �tasunienne annuelle!) pour faire avancer son projet de d�possession du peuple palestinien. Ainsi, le nombre de colons juifs ill�gaux a plus que doubl� dans les territoires occup�s depuis la signature des Accords d'Oslo... Ainsi, alors que les m�dia nous parlent d'accalmie et du retrait annonc� de quelques milliers de colons de Gaza, ils passent sous silence ce que m�me des organisations isra�liennes comme Gush Shalom qualifient de projet d'annexion d'une grande partie de la Cisjordanie ! Anticipant un autre mur ou d'autres modes d'annexion de la Vall�e du Jourdain, sur le flanc est de la Cisjordanie, la /Palestinian Grassroots Anti-Apartheid Wall Campaign/, estime m�me qu'� terme, une fois ces constructions compl�t�es, combin�es aux colonies juives de peuplement de la Cisjordanie (environ 400 000 colons), aux autoroutes pour Juifs seulement et aux soi-disant � zones militaires �, ce sera 46 % de la Cisjordanie qu'on aura ainsi annex�s de facto. La position du Canada est d'ailleurs de plus en plus semblable � celle des �tats-Unis. D�j� en avril 2002, apr�s l'effroyable incursion punitive de l'arm�e isra�lienne � Jenine, le Canada fut l'un des deux seuls pays (sur 53) � la Commission des droits de l'homme des Nations Unies � s'opposer � l'envoi d'une mission d'enqu�te de la Commission. Et le 1er d�cembre 2004, � l'Assembl�e g�n�rale des Nations Unies, il fut l'un des sept pays (sur 174) � voter contre la r�solution habituelle r�it�rant le mandat du Comit� pour l'exercice des droits inali�nables du peuple palestinien. Les six autres pays oppos�s : Isra�l, les �tats-Unis, l'Australie, la Micron�sie, les �les Marshall et Palau... _Quoi faire ?_ Dans le conflit isra�lo-palestinien, le droit international est clair, mais les �tats et l'ONU ne le font aucunement appliquer. Certains sont m�me des alli�s inconditionnels d'Isra�l. Dans ce contexte, malgr� la r�sistance h�ro�que du peuple palestinien, le rapport de forces lui est d�favorable et de simples n�gociations ne lui rendront pas justice. Nous devons donc d�velopper des campagnes d'information et de pression sur les grands acteurs �conomiques et politiques de nos pays respectifs pour les forcer � se d�solidariser ouvertement du colonialisme et de l'apartheid isra�liens, comme cela fut fait contre l'apartheid en Afrique du Sud. Les Palestiniens ont obtenu un jugement sans �quivoque de la Cour internationale de Justice sur le mur. � nous de nous en servir pour avancer dans cette direction. Le mur doit tomber. Le Canada doit l'exiger. � nous d'y voir ! With 80% of the wall's path deviating from the 1967 Armistice Line, the wall places on the "Israeli side" almost 10% of the West Bank, totalling surrounding some villages. According to the United Nations, 680 000 Palestinians will directly experience the impact of this wall, being cut off from their agricultural lands, from their jobs, their schools, their clinics, etc. Upon completion, in about one year, it will have cost more than 3 billion dollars. A monstrous implementation of the apartheid policies of the Israeli occupation, this wall is totally illegal. Here are some basic facts on this. *On 8 December 2003*, the United Nations' General Assembly requests an advisory opinion on the wall from the International Court of Justice (ICJ) in The Hague. Ninety countries vote _in favour_ of requesting such an opinion, 8 countries vote _against,_ and 74 countries _abstain_, including Canada. *During the following weeks*, a few countries write to the International Court of Justice to challenge its competence in ruling on such matters; a few other countries - including Canada, on 29 January 2004 - "respectfully request that the Court exercise its discretionary power and refuse to answer the request for an advisory opinion at the present stage"! *On 9 July 2004*, 15 judges of the International Court of Justice make their decision public : � They find that the ICJ has jurisdiction to give the advisory opinion requested (unanimously); � They decide to comply with the request for an advisory opinion (For: 14 judges out of 15. Dissenting: one, the US judge); � They rule as follows : o "The construction of the wall being built by Israel, the occupying Power, in the Occupied Palestinian Territory, including in and around East Jerusalem, and its associated r�gime, are contrary to international law" (For: 14 judges out of 15. Dissenting: one, the US judge); o "Israel is under an obligation (...) to cease forthwith the works of construction of the wall, (...) to dismantle forthwith the structure" (For: 14 judges out of 15. Dissenting: one, the US judge); o "Israel is under an obligation to make reparation for all damage caused by the construction of the wall" " (For: 14 judges out of 15. Dissenting: one, the US judge); o "All States are under an obligation not to recognize the illegal situation resulting from the construction of the wall (...); all States parties to the Fourth Geneva Convention (...) have in addition the obligation (...) to ensure compliance by Israel with international humanitarian law as embodied in that Convention (For: 13 judges out of 15. Dissenting: two, the US and Dutch judges); o "The United Nations, and especially the General Assembly and the Security Council, should consider what further action is required to bring to an end the illegal situation resulting from the construction of the wall (...)" So the construction of the wall is illegal. Just as are actually illegal the Israeli occupation of the West Bank and the Gaza Strip, the construction of Jewish settlements in these occupied territories, the annexation of East-Jerusalem, the denial of Palestinian refugees' right to return, the appropriation by Israel of the underground water in the occupied territories, the thousands of arbitrary detentions and the torture inflicted to Palestinian prisoners, the collective punishment such as the destruction of the homes or the orchards of the families of presumed � terrorists � and the complete closures of towns and villages, the extra-judicial executions of presumed � terrorists � (at times, with missiles and one-ton bombs), etc. _And what does Canada do?_ Faced with all of this, Canadian policy is fundamentally hypocritical and favorable to the State of Israel. For even if Canada states that it is against the occupation, the settlements and the wall, it totally fails to fulfil its obligations under international law by taking no measures "to ensure compliance by Israel". On the contrary, it maintains privileged commercial relations with Israel (free trade agreement) and even tries to prevent the Palestinian people from resorting to international law to condemn Israeli crimes and illegal actions. By repeatedly and solely insisting on a "negociated settlement", Canada's rhetoric hides two fundamental facts.. One, that this is not a "conflict" to be resolved between "parties", but that Israel is an illegal occupying power in Palestine. And two, that Israel harbours no real intention to negociate, but rather aims at buying time and using this time (and the 5 billion dollars of annual US aid!) to further advance its project of dispossessing the Palestinian people. The number of illegal Jewish settlers has practically doubled in the occupied territories since the signing of the Oslo Accords in 1993... And while the media are talking about the current lull and the announced withdrawal of a few thousand settlers from Gaza, they remain silent on what even Israeli organisations such as Gush Shalom see as Israel's plan of annexation of a large part of the West Bank! Anticipating another wall or other means of annexing the Jordan Valley, on the east side of the West Bank, the /Palestinian Grassroots Anti-Apartheid Wall Campaign /estimates that once these constructions are completed, combined with the Jewish settlements in the West Bank (approximately 400 000 settlers), the Jewish-only roads, and the so-called "military zones", this will amount to the /de facto /annexation of 46% of the West Bank. Canada's position is actually becoming more and more similar to that of the US. Already, in April 2002, in the aftermath of the horrific punitive incursion of the Israeli army in Jenin, Canada was one of only two countries (out of 53) at the United Nations Commission on Human Rights to oppose the sending of a special investigating team to Jenin. On December 1^st 2004, at the UN General Assembly, it was one of the seven countries (out of 174) to vote _against_ a standard annual resolution reiterating the mandate of the Committee on the Exercise of the Inalienable Rights of the Palestinian People. The six other countries opposed were: Israel, the US, Australia, Micronesia, the Marchall Islands, and Palau... _What to do ?_ On the Israeli-Palestinian conflict, international law is clear. But neither the UN nor its member States ensure its application. Some are even unconditional allies of Israel. In this context, despite the heroic resistance of the Palestinian people, the balance of force is not favorable to their cause and simple negociations will not bring them justice. So we must launch information and pressure campaigns on the key economic and political players in our respective countries to force them to openly break ties with Israeli colonialism and apartheid. The Palestinian people have obtained a ruling from the International Court of Justice on the wall. Now it falls upon us to use this ruling to advance in this direction. The Wall Must Fall.
